If H1 petition is approved by INS and you do not hide anything in the VISA appln. and you are not a criminal, no consulate can deny you visa. Earlier H1 could be denied if the consul officer is not convinced about your non-immigrant intent. This clause has now been removed and it H1 is very very safe. This was back in August. I'm going to my home country (Peru) to get my visa this December. I have not heard of any H1 visa denial since the 'new' law is in effect. Intention to immigrate to US is not a reason for denial now. I cannot think of any other reason if your status has always been according to rule. A girl from my college back home had done something similar: she had her H-1 but no multiple. Her visa was rejected in Madras and she ended up staying in India. I also know of folks that have gotten multiple H1 s in India. If u ask me DONT TAKE ANY CHANCES. Get yr multiple from Mex or Canada before you go home. I have known hazaar guys that got their visas from Juarez. If u take all yr documents with you, you will certainly get a visa from Juarez. Way around: If u can get an I-20 from your school for the next semester, Ph.D. or whatever, you can use yr multiple F-1 visa (if u have one) to travel back. You need not submit yr original I-94 when leaving the US (- this one has yr H-1 stamp). If the airline people want you to submit the I-94 white card, ask them for a blank card, fill it up and they will just throw it in a box- it doesn't mean a thing. The folks at the port of entry will let you in on your F-1. There is no way they will know that you have been granted a H-1. After you enter the country, just trash the fresh F-1 I-94 they give you at the port of entry. The above is very simple - nothing to worry about and it has worked perfectly fine for a colleague of mine. The consulate officer asked to see my appointment letter (but no pay stubs), hence I would say you need to be employed. She also asked to see the H!B approval letter from INS (the blue form).
